PHOTO/TESTIMONIAL WAIVER FOR LINDSAY KIRSCH AND THE COMPANY
I understand my testimonial, photograph, or short biography (hereinafter referred to as the “Testimonial”) and made on behalf of Lindsay Kirsch (hereinafter referred to as “The Company”) may be used to publicize and promote The Company. I authorize The Company to use my name, photograph, brief biographical information, and the Testimonial as defined on this waiver.
I hereby authorize The Company to copy, exhibit, publish or distribute the Testimonial for purposes of publicizing The Company’s programs or for any other lawful purpose. The Testimonial may be quoted, in whole or in part, paraphrased, used in printed publications, multimedia presentations, on websites or in any other distribution media. I understand the Testimonial may be used with or without my name. I acknowledge that although The Company may choose not to use my photograph or Testimonial now; The Company and may do so at its own discretion, at a later date. I agree that I will make no monetary or other claim against The Company for the use of the statement.
In addition, I waive any right to inspect or approve the finished product, including written copy, wherein my likeness or my testimonial appears. Once my image and testimonial is posted on The Company’s web site, the image and testimonial can be downloaded by any internet user, which is beyond the control of either The Company or Lindsay Kirsch.
I hereby release and hold harmless both The Company and Lindsay Kirsch personally, from all downloads, claims, demands and causes of action which I, my heirs, representatives, executors, administrators, assigns or any other persons acting on my behalf or on behalf of my estate have or may have due to this authorization.
I acknowledge that I have a right to revoke use of the Testimonial. Any revocation of the Testimonial must be dated and completed in writing and sent to Lindsay Kirsch at Suite 1591, Amherst, NY 14226
This agreement, its validity, construction and effect shall be governed by the laws of the State of New York. I have read the authorization and release information and give my consent for the use as indicated above.
